RDD Auction Company, LLC Sale Yard

Buyer's Terms and Conditions

By Registering, you are agreeing to all Terms and Conditions either written or announced by RDD Auction Company, LLC.

All bidders must register and have a Buyer Number prior to bidding.

Items awarded to a Buyer's Number will be billed to the account the Buyer Number is assigned.  If you buy for more than one account, separate Buyer Numbers are needed.

All Bidders with a Permanent Buyer’s Numbers are responsible for making themselves familiar with any updates to any and all Terms and Conditions, either written or announced.

All announcements, made the day of the auction take precedence over all other prior advertisements or verbal statements.

All items listed for this auction are selling “AS-IS, WHERE IS” with all faults.

RDD Auction Company, LLC makes no representations or warranties, written or implied, concerning the items being sold.

RDD Auction Company, LLC is not responsible for statements made by third parties.

Descriptions are believed to be correct, but are not guaranteed. It is the Buyer’s responsibility to inspect any item(s) of interest prior to the auction and before placing a bid.

By placing a bid on an item, you subsequently agree that you have obtained all information regarding quantity and condition by personally inspecting or an inspection by your agent and that you are familiar with all regulatory requirements associated with the item.

All registered bidders are allowed to bid on any item offered.

The Auctioneer or RDD Auction Company, LLC reserves the right to refuse or reject any and all bids.

Item(s) may be withdrawn before or the day of the auction due to circumstances beyond our control.

Once you are determined as the "Successful Bidder", all items awarded become your responsibility.

RDD Auction Company, LLC, its staff or agents are not responsible for any accidents, injury, fire, or theft.

Any item(s) awarded must be removed from the premises within 10 business days following the auction.

Items left over 30 days will be considered abandoned and moved to an unsecure storage area and become the property of RDD Auction Co., LLC.


Buyer’s Payment Terms

No "Buyer's Premium" for on-site bidders.

Online Bidder Fees:
10% Online Buyers Premium Capped at $500
+ 2% Internet Service Fee (not capped)

Cash, Credit/Debit Cards, Cashier's Check or Approved Personal and Business Checks in US dollars will be accepted.  VISA, MasterCard, and Discover ONLY.

All checks (without prior approval) must be accompanied by a Certified Bank Letter that states the availability of sufficient funds; and, must be issued within 7 days preceding the Auction date; and, issued by a US bank holding the account of the check rendered.

A 3% Convenience Fee will be added for all credit or debit card payments.

A $15.00 Convenience Fee will be added to payments made by bank transfer.

There will be a $35.00 charge for each Returned Check.

On-site bidders -  All items purchased must be paid for in full the day of the auction unless prior  arrangements were made and approved.

Internet Bidders - All Payments are due before the close of business on the third business day following the auction.

Payments must be rendered per the RDD Auction Company, LLC invoice.

Internet Bidders are to call the auction office on the next business day after the sale to discuss payment method and other special information; to include but not limited to: invoices, wire transfer, instructions and pick-up scheduling.

 All applicable "Sales Taxes" will be applied to the final invoice amount.  Sales Tax for qualified exemptions will not be added if a copy of a valid Tax ID Card and a valid Form E-595E is on file.

A $25.00 Late Fee may be applied to invoices not paid prior to the end of the third business day following the auction.

Absentee and Phone Bids - A 3% Convenience Fee will be added for all Absentee and Phone Bids.

State Sales Tax - Tax exempt forms should be presented when you register to bid.  Applicable taxes will be applied if no Tax exempt information is on file.  No Refunds for Taxes will be granted once the invoice is generated.

Load-Out Instructions

A "Paid in Full" invoice must be presented to RDD staff prior to loading.

We will begin loading on the day of the sale when the operation can be done safely as determined by the loader operators.  Please be patient.

After sale day, you may pick your items up Monday - Friday 8:00 AM  - 5:00 PM.  The gates close at 5:00 PM.  All items are to be removed or you must communicate your desire to add your items to the next sale within 30 days.

Our loaders can only be operated by RDD staff.  Our staff will be glad to assist in loading your items.  However, order of loading and placement, securing the load and meeting DOT requirements are the responsibility of the driver.  A limited supply of: pins, straps, chains and bidders are available for sale in the office.

Shipping - Shipping is the responsibility of the buyer.  Bidders that may need assistance with packaging and shipping of an item of interest must call the RDD Auction Co., LLC office prior to bidding.  Regulatory packaging requirements may be beyond our capabilities.  Additional fees may apply.

NOTICE:  Should the successful bidder fail to remove awarded item(s) within 30 days of the date of the auction, the item(s) become the property of RDD auction Company, LLC.


Seller’s Terms

Items must be delivered before the advertised cut-off time unless prior arrangements have been made.  We can accept your items Monday - Friday 8:00 AM to 5:00 PM .  The gates close at 5:00 PM.

Seller’s Account information must be presented in the office at time of delivery.  NOTE: Checks are written and mailed to the name and address on the account.

We ask that you provide complete descriptive information of your items when consigned.  If there are any non-visible issues other than normal wear of an item that may reduce its value, we ask that you provide this information so we may provide it to potential buyers.

Our selling fee will be deducted from the Reserve amount stated.

For items without Reserve, RDD Auction Co. retains the right to sort and group items as necessary.

RDD Auction Company, LLC reserves the right to withdraw any item from an auction.

Titled Items

For items with a Title or Certificate of Origin, the Title or CoO must be presented to the office staff at the time the item is delivered for consignment.

Checks will be made payable to the Name on the Title.  We do not accept open titles.

Important Tax Update
from RDD Auction, LLC.

Beginning on February 1, 2020 the North Carolina Department of revenue is requiring sales tax

to be collected on ALL auctions held in the state of North Carolina.

(N.C. Gen. Stat. § 105-164.4J)

This means that ALL auctions, at our home site and away, will be subject to sales tax.

If you have a NC Sales Tax Except number, we MUST have a completed E-595E form for our records. We have forms on-site but encourage you to fill out your form using the link below and have it completed and ready for us on sale day. Once this completed form is turned in and we have it on our records, it is not necessary to bring a completed form each time you make a purchase.

You will NOT be considered tax exempt unless this form is in hand, or your information is already in our system. If you are an out-of-state buyer, you STILL need to have a North Carolina Tax Exception number on file with us. The process to apply for one can be found on NCDOR’s website at the link below.
